Acceptance of Terms
By accessing the Elite Executive Productivity Coaching website or engaging our coaching services, you agree to be bound by these Terms of Service, all applicable laws, and regulations. If you do not agree, do not use our services. We reserve the right to update these terms at any time; continued use constitutes acceptance of changes. You affirm you are at least 18 years old or accessing under parental supervision.
Coaching Services & Scope
We provide executive productivity coaching, including but not limited to strategy sessions, one-on-one coaching calls, workshops, and digital resources. Our services are advisory in nature and do not constitute psychological or medical advice. Results are not guaranteed; individual outcomes depend on client engagement and application of recommended practices. We reserve the right to modify or discontinue services with reasonable notice.
Client Responsibilities
Clients must provide accurate information, actively participate in sessions, and complete assigned exercises. Clients are responsible for securing their own technology (e.g., stable internet, webcam) to attend virtual sessions. Failure to attend scheduled sessions without 24-hour notice may result in forfeiture of that session. We may terminate the engagement if a client violates these terms or engages in disruptive behavior.
Payment & Refund Policy
Fees are due as per the agreed payment schedule (e.g., upfront, monthly installment). Payments are processed via secure third-party gateways; we do not store full credit card numbers. Refunds are provided only for services not yet rendered, minus a 10% administrative fee. No refunds are given for completed sessions or digital products. Late payments may incur a 5% monthly finance charge and suspension of services until resolved.
Intellectual Property
All materials provided, including frameworks, templates, videos, and workbooks, are the proprietary intellectual property of Elite Executive Productivity Coaching. You may use them solely for your personal or organizational coaching purposes. You may not reproduce, distribute, modify, or create derivative works without prior written consent. Our name, logo, and tagline are trademarks; unauthorized use is prohibited.
Limitation of Liability
To the fullest extent permitted by law, Elite Executive Productivity Coaching shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services. Our total liability for any claim shall not exceed the total fees paid by you in the twelve (12) months preceding the claim. We are not responsible for any loss of business, revenue, or profits resulting from coaching advice.
Dispute Resolution & Governing Law
Any disputes shall first be resolved through good-faith negotiation. If unresolved, disputes will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Rules, with each party bearing its own costs. The arbitration shall be held in Metropolis, California. These terms are governed by the laws of the State of California, without regard to conflict of law provisions.
